TestAxion Privacy Policy

1. Introduction & Strict B2B Scope 
TestAxion (“we”, “our”, or “us”) is committed to protecting the privacy and security of the professional and technical data entrusted to us. This Privacy Policy explains how we collect, process, and disclose information when you engage with our B2B Quality Assurance (QA) and software testing services (collectively, the “Services”).

Zero-Consumer Liability: 
This policy and our Services are designed strictly for business-to-business (B2B) operations. TestAxion acts solely as a Data Processor. Clients are strictly prohibited from exposing live end-user Personally Identifiable Information (PII) or Protected Health Information (PHI) to our testing environments without prior data masking or anonymization. The Client bears 100% legal and financial responsibility for any unmasked consumer data inadvertently exposed to us during the testing cycles.

2. Information We Collect 
We adhere to data minimization, collecting only what is necessary:

  • Business Contact Information: Your name, corporate email, job title, and company details.
  • Architecture & Technical Data: System architecture details, API endpoints, staging credentials, and release timelines.
  • Automated Usage Data: IP addresses, browser types, and navigation paths collected via analytics.
  • Communications Monitoring: We reserve the right to monitor and store electronic communications (emails, support tickets, video meetings) for QA, training, fraud prevention, and legal defense.

3. How We Use Your Information 
We process your data strictly to:

  • Execute and deliver the QA testing you requested.
  • Communicate securely regarding audit results and vulnerabilities.
  • Defend our legal rights, enforce our Terms of Service, and conduct internal audits.
  • Secure our infrastructure against fraud, DDoS attacks, and unauthorized access.

4. Data Retention and Deletion 
We retain Business Contact Information as long as your corporate account is active. Operational test data (such as HD Video Evidence, bug logs, and staging credentials) are retained for a maximum of ninety (90) days following the completion of a specific test cycle. After this period, they are securely and permanently deleted from our servers, unless a different retention period is required by law or explicitly requested in writing by the Client.

5. Data Sharing and Sub-Processors We do not sell your data. We share information only with trusted third-party service providers (Sub-processors) to facilitate our Services (e.g., Cloudflare, Google Workspace, Jira). Limitation of Third-Party Liability: While we carefully select our Sub-processors, TestAxion expressly disclaims liability for data breaches or outages originating directly from these third-party infrastructure providers, provided we exercised reasonable due diligence in their selection.

6. International Data Transfers 
Your information may be transferred to and processed in jurisdictions outside your country of residence. We ensure that any international transfer of personal data is safeguarded by recognized legal mechanisms, such as Standard Contractual Clauses (SCCs), ensuring compliance with GDPR and global regulations.

7. Data Security, Breach Notification & Exemption from Liability 
We implement rigorous technical measures to protect your data. However, no transmission of data over the internet is 100% secure. TestAxion disclaims any absolute guarantee of data security. To the maximum extent permitted by law, TestAxion shall not be held liable for any unauthorized access, zero-day exploits, or data breaches caused by factors beyond our direct and reasonable control. Breach Notification: In the highly unlikely event of a confirmed data breach that compromises Client data, TestAxion commits to notifying the affected Client’s primary contact without undue delay, and legally within 72 hours of becoming aware of the incident.

8. Your Privacy Rights & Exceptions 
Depending on your jurisdiction (e.g., GDPR, CCPA), you have rights to request access, rectification, or erasure of your personal data. Exceptions to Rights: TestAxion reserves the absolute right to refuse requests for data access or deletion under extraordinary circumstances, including: (a) when fulfillment compromises ongoing fraud or security investigations; (b) when doing so would expose TestAxion’s proprietary trade secrets or testing methodologies; or (c) when retention is strictly necessary for legal compliance or dispute resolution.

9. Consequences of Withdrawing Consent 
You may withdraw your consent for data processing at any time. However, you acknowledge that withdrawing consent or refusing to provide necessary technical access will render TestAxion unable to perform the Services. In such events, TestAxion reserves the right to immediately terminate the engagement, subject to the financial terms outlined in our Terms of Service.

10. Changes to this Privacy Policy 
We may update this Privacy Policy periodically. We will notify you of material changes by updating the “Effective Date.” Your continued use of the Services constitutes your binding acceptance of the new Policy.
